Terms of Service

Accounts

When you create an account with us through Google Sign-In, you must provide accurate and complete information. You are responsible for safeguarding your account and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

Subscriptions

Some parts of the Service may be billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

Subscription payments are processed through Stripe, a third-party payment processor. By subscribing to our Service, you agree to Stripe's Terms of Service. Your payment information is securely handled by Stripe and is not stored on our servers.

Subscription Renewals and Cancellation

Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your account settings on the Esportsfort website or app.

Free Trial

Esportsfort may, at its sole discretion, offer a Subscription option with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected. At any time and without notice, Esportsfort reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Fee Changes

Esportsfort, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Esportsfort will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Except when required by law, paid Subscription fees are non-refundable. Refund requests may be considered on a case-by-case basis at our sole discretion.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Limitation of Liability

Under no circumstances shall Esportsfort, its directors, employees, partners, agents, suppliers, or affiliates, be held responsible for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, losses related to profits, data, usage, goodwill, or other intangible losses that may arise from (i) your ability or inability to access or use the Service; (ii) the conduct or content of any third party on the Service; (iii) any content obtained from the Service; or (iv) unauthorized access, usage, or alteration of your transmissions or content.

Furthermore, Esportsfort accepts no liability for any gambling behavior undertaken by the user outside of our Services. Any such activities are conducted at the user's own risk and responsibility, and we urge all users to behave responsibly when engaging in such activities.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Esportsfort, its subsidiaries, affiliates, and its licensors do not warrant that (a) the Service will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

Proprietary Rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly permitted by applicable law or authorized by us, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service.

The terms Esportsfort, the Esportsfort logo, and other Kin-Yee logos and product and service names are the exclusive trademarks of, and are owned by Kin-Yee, and you may not use or display such trademarks in any manner without our prior written permission. Any third party trademarks or service marks displayed on the Service are the property of their respective owners.

Third-Party Trademarks and Affiliation Disclaimer

Esportsfort is an independent esports tracking service and is not endorsed by, directly affiliated with, maintained, authorized, or sponsored by any video game company, game developer, esports organization, team, or player featured in the Service.

All product and company names, logos, and trademarks are the property of their respective owners. The following trademarks are used solely for identification purposes:

• League of Legends and Riot Games are trademarks or registered trademarks of Riot Games, Inc. League of Legends © Riot Games, Inc.
• Counter-Strike 2 and Valve are trademarks or registered trademarks of Valve Corporation.

The use of these trademarks does not imply any affiliation with or endorsement by their respective owners. All esports data, match information, and statistics are provided for informational purposes only.

If you are a rights holder, game developer, esports organization, team, or player and would like to request exclusion from or modification of how your content is displayed on our Service, please contact us through the communication channels provided by Esportsfort on its apps and website.

Governing Law

These Terms and any non-contractual obligations arising out of or in connection with it will be governed by and construed and interpreted in accordance with Dutch law. These Terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. Any disputes regarding these Terms will be submitted to the exclusive jurisdiction of the competent court in the Netherlands.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
